“We,” “us,” “our” and “Bestie Defense” refers collectively to Bestie Defense LLC, a Delaware limited liability company and its subsidiaries, officers, directors, members, owners, affiliates, successors, and assigns.

This Privacy Policy does not apply to websites or mobile apps that operate independently from us. Please reference the privacy policies for such websites for information on how they collect and use customer information.

THE INFORMATION WE COLLECT

Personal Information

USE OF PERSONAL INFORMATION AND OTHER INFORMATION

We may use Personal Information and Other Information for various purposes, including (without limitation): communicating with Website users, complying with the law, helping to establish and verify the identity of Website users; opening, maintaining, administering and servicing users’ accounts; processing, servicing or enforcing transactions, sending related communications; providing services and support to Website users; personalizing your experience with the Website including information that relates to your geographic location; improving the Website including tailoring it to users’ preferences; providing users with product and service updates, promotional notices, and offers, providing information about Bestie Defense products; marketing to you; responding to your questions, inquiries, comments, and instructions; identification and authentication of your account login and password, and maintaining the security and integrity of our systems.

We may engage other companies to perform a variety of functions, such as to fulfill orders, assist with promotions, provide technical assistance, etc. (collectively, “Related Companies”). Related Companies may use your Personal Information to the extent necessary for these companies to fulfill their functions for us.

In certain cases, we transfer Personal Information to third parties based on legitimate interests and the economic and technical advantages associated with the use of specialized providers.

We reserve the right to use or disclose any information to satisfy any law, regulation, or legal request, to protect the integrity of the Website, to fulfill your requests, or to cooperate in any law enforcement investigation.

We may share aggregate, non-individual information, incapable of identifying a person, with third parties for lawful purposes.

If Bestie Defense undergoes a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer all of your information, including Personal Information, to the successor organization in such transition. If material changes to our privacy practices occur as a result of the business transition, we will notify you in the manner described above of the business transition prior to transferring your Personal Information.

We will not disclose, transfer, assign, sell, rent, or lease any Personal Information we collect from you to others except as described above.

Children’s Privacy

The products that we offer via the Website are intended only for people 18 and older. We do not knowingly collect or solicit information from children under the age of 18 on the Website without the consent of such child’s parent. In the event we learn that we have inadvertently collected Personal Information from a child under age 18 without parent consent, we will delete that information as quickly as possible. California Consumer Privacy Act/California Privacy Rights Act

The California Consumer Privacy Act (“CCPA”) and as expanded by the California Privacy Rights Act (“CPRA”) provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of their “Personal Information,” as well as rights to know/access, delete, and limit sharing of Personal Information. Categories of CA Personal Information We Collect and Purposes for Collection.

You have the right to receive notice of the categories of Personal Information we collect and the purposes for which those categories of Personal Information will be used. The categories we use to describe the information are those enumerated in the CCPA. Consistent with the "Information We Collect" and “Use of Your Personal Data”  sections in the general privacy policy, we may collect certain categories of information about California consumers ("CA Personal Information"), specifically as follows:

Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)). In addition to information in the Personal Identifiers section above, our service providers collect your credit card number, debit card number, or any other financial information you submit to process payments, fees, charges, billing, and collections, so that we provide you with information, products, or services that you request from us. We may use this information, to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations. We do not retain this information in our systems. The service provider processes payment only and may not use the information for any other purpose.

Protected classification characteristics under California or federal law. We may collect age or date of birth from you in forms to validate that you are not under the age of eighteen (18) because children under the age of eighteen (18) are not permitted to purchase products from the Website. From sources other than you, we may also collect age, gender, marital status, occupation, and demographics (any additional email/postal addresses or phone numbers you may have used), to further understand our customers and personalize offerings of products or services. We do not knowingly collect this information from children. To the extent permitted by law, we retain this information indefinitely until we receive a request that it be deleted.

Commercial Information. We may collect information about online activity data, products or services purchased or considered, or other purchasing or consuming histories or tendencies, to provide you with information, products, or services that you request from us and to improve them. To the extent permitted by law, we retain this information indefinitely until we receive a request that it be deleted.

Internet or Other Electronic Network Activity Information. Inferences drawn from other personal information. Right to Know/Access Information/Correct Inaccurate Personal Information. You have the right to request access to Personal Information collected about you and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. Additionally, you have the right to correct inaccurate or incomplete Personal Information. You may submit such a request as described below.

Right to Request Deletion of Information. You have the right to request in certain circumstances that we delete any Personal Information that we have collected directly from you. You may submit such a request as described below. We may have a reason under the law why we do not have to comply with your request, or why we may comply in a more limited way than you anticipated. If we do, we will explain that to you in our response.

How to Exercise Your Rights. You may submit a request to exercise your State Data Privacy Rights by sending us an email at heybestie@bestie-defense.com that identifies the website(s) you interacted with and any email addresses you provided or used to create an account.

Authentication Process. To protect consumers’ Personal Information, and to comply with the CCPA, we will use a verification process to confirm your identity before we act on your request. If you use an authorized agent to submit a request on your behalf, we may require that you (1) provide the authorized agent with written permission to do so, and (2) provide us with a copy of the authorization or a copy of a power of attorney.

In authenticating requests, we employ reasonable measures to detect fraudulent requests and prevent unauthorized access to your personal information. To meet our obligations, we are required to authenticate your identity and the identity of your authorized agent, if the request is submitted via an agent, by associating the information provided in your request to personal data previously collected by us.

If we suspect fraudulent or malicious activity on or from the password-protected account, we may decline a request or request that you provide further authenticating information.

Making an authenticated consumer request does not require you to create an account with us. We will only use personal data provided in an authenticated consumer request to authenticate your identity or authority to make the request.

Right to Opt Out of Sale of Personal Information to Third Parties. You have the right to opt out of any sale of your Personal Information by Bestie Defense to third parties. We do not sell information to third parties. We do not knowingly sell CA Personal Information of consumers younger than the age of 16.

Right to Information Regarding Participation in Data Sharing for Financial Incentives. You have the right to be free from discrimination based on your exercise of your CCPA rights. We do not discriminate against anyone who chooses to exercise their CCPA rights.

Shine the Light Law. While we do not provide your personal information to third parties for their use in marketing, under California law, California residents have the right to opt-out of such use of your personal information if it occurred. California residents are entitled once a year, free of charge, to request and obtain certain information regarding our disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. Right to Access/Obtain a Copy of Personal Information. If we decline to take action in any request that you submit in connection with the rights described in the above sections, you may ask that we reconsider our response by sending an email to the same email box (referenced in section below) from which you receive the decision. You must ask us to reconsider our decision within 45 days after we send you our decision. If your appeal is denied, Bestie Defense will inform you of how to submit a complaint to your Attorney General.

Sensitive data means personal data that includes data revealing racial or ethnic origin, religious beliefs, mental or physical health condition or diagnosis, sex life, sexual orientation, or citizenship or immigration status, (B) genetic or biometric data for the purpose of uniquely identifying an individual, or (C) personal data from a known child.

Personal Information we collect in this category: We may collect age or date of birth from you in forms to validate that you are not under the age of eighteen (18) because children under the age of eighteen (18) are not permitted to use the Website or product products from the Website.

Purpose for Processing Sensitive Data: We collect age or date of birth to comply with the law and to determine whether a use can legally purchase our products. We obtain demographic information from sources other than you to further understand our customers and personalize offerings of products or services to optimize your experience with us.

Third Parties With Which We Share Sensitive Data: We do not share Sensitive Data with third parties except as required by applicable law.
